Welcome to DW-NFC (“DW-NFC”, “we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of our website, products, and services, including the purchase of DW NFC Cards (collectively, the “Services”).

By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1) Business Information

2) Eligibility

You must be legally capable of entering into a binding contract to use the Services. If you use the Services on behalf of a company or organisation, you confirm you have authority to bind that entity to these Terms.

3) Orders & Payments

When you place an order, you agree that:

  • All information you provide is accurate and complete (including delivery address, contact details, and order selections).

  • Your order is an offer to purchase. We may accept or reject orders at our discretion (e.g., suspected fraud, incorrect pricing, stock limitations).

Payment must be made in full at checkout (unless otherwise agreed in writing). Prices and availability may change without notice.

4) Pricing & Currency

All prices shown on the website are in Malaysian Ringgit (MYR) unless stated otherwise. Any delivery charges are calculated at checkout.

5) Production, Customisation & Customer Content

DW-NFC products may include customisation (e.g., design, printing, setup). By providing any content (e.g., name, logo, phone number, links, images) to us for customisation (“Customer Content”), you confirm:

  • You own or have permission to use the Customer Content; and

  • The Customer Content does not infringe any third-party rights or violate any laws.

You grant us a limited licence to use Customer Content solely to fulfil your order (e.g., design mockups, production, setup). We will not use Customer Content for marketing unless you give us permission.

6) Proofing & Approval (Important)

If we provide a design proof/mockup for approval:

  • You are responsible for checking spelling, numbers, URLs, names, and all details before approving.

  • Once you approve a design, production may begin and changes may not be possible.

If you request changes after approval, additional charges and/or delays may apply.

7) Shipping & Delivery (Malaysia)

Shipping is subject to our Shipping Policy. In summary:

  • Delivery area: West Malaysia / Peninsular Malaysia only

  • No shipping to East Malaysia (Sabah & Sarawak) at this time

  • Processing/production: typically up to 10 days

  • Courier transit: typically 1–3 days after dispatch

Delivery dates are estimates and not guarantees. Delays may occur due to courier operations, peak periods, weather, or events outside our control.

8) Returns, Refunds & Damaged/Incorrect Items

Returns and refunds are subject to our policies and applicable consumer law.

Because many DW-NFC products are custom-made, change-of-mind returns may not be accepted for customised items, unless required by applicable law.

If you receive:

  • Incorrect item: do not open/use it and contact us immediately.

  • Damaged item: contact us within 4 days of delivery with photos/videos of the item, packaging, and shipping label.

We may request the item be returned before a replacement/refund is issued.

9) NFC Compatibility & User Responsibility

NFC performance may vary depending on device model, OS settings, cases, and environment. You are responsible for:

  • Ensuring your phone/device supports NFC and has NFC enabled (where applicable).

  • Using the product in a normal manner and not modifying/damaging the chip or structure.

We do not guarantee compatibility with every device or future OS updates.

10) Intellectual Property

All content on the website (including text, images, logos, branding, designs, and layout) is owned by or licensed to DW-NFC and is protected by intellectual property laws.

You may not copy, reproduce, distribute, modify, or exploit any part of our content without written permission, except for personal, non-commercial viewing.

11) Prohibited Use

You agree not to use the Services to:

  • Break any law or regulation;

  • Infringe intellectual property or privacy rights;

  • Upload malware or interfere with the website;

  • Misrepresent identity, impersonate others, or commit fraud;

  • Use the NFC card/profile for harmful, illegal, or abusive activities.

We may suspend or terminate access if we believe you violate these Terms.

12) Third-Party Links & Services

Our website or NFC profiles may contain links to third-party websites or services (e.g., WhatsApp, Instagram, websites). We do not control and are not responsible for third-party content, policies, or availability.

13) Disclaimer

To the maximum extent permitted by law, the Services and products are provided “as is” and “as available”. We do not guarantee uninterrupted access, error-free operation, or that the Services will meet every user’s expectations.

Nothing in these Terms excludes consumer guarantees that cannot be excluded under applicable Malaysian law.

14) Limitation of Liability

To the maximum extent permitted by law:

  • DW-NFC will not be liable for indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or business opportunities).

  • Our total liability for any claim relating to an order or the Services will not exceed the amount you paid for the specific product/order giving rise to the claim.

15) Indemnity

You agree to indemnify and hold DW-NFC (including DWORK BENCH ENTERPRISE, its owners, staff, and partners) harmless from claims, damages, liabilities, and expenses arising from:

  • Your misuse of the Services/products;

  • Your Customer Content;

  • Your breach of these Terms; or

  • Your violation of laws or third-party rights.

16) Changes to Terms

We may update these Terms from time to time. Updates will be posted on this page with a revised “Last updated” date. Your continued use of the Services after changes means you accept the updated Terms.

17) Governing Law

These Terms are governed by the laws of Malaysia. Any disputes will be subject to the exclusive jurisdiction of the courts of Malaysia (unless applicable law requires otherwise).
